Service Disclaimer,
Assumption of Risk,
and Limitation of Liability Agreement

This document—being at once a disclaimer, an acknowledgment, a reflection, a gentle celebration of creative possibility, and, in certain readings, a mildly philosophical meditation on expectation versus reality (hereinafter, the “Agreement,” though it may feel like more of an experience)—is entered into by and between REDNUG® LLC (hereinafter, with all due breadth and inclusivity, “REDNUG® ”), and the individual, entity, dreamer, optimist, or otherwise hopeful participant (hereinafter, the “Client”).

 

WHEREAS, REDNUG® wishes to express, in no uncertain yet entirely non-binding terms, that it is genuinely, sincerely, and perhaps even disproportionately honored to be entrusted with the Client’s project—such opportunity being regarded not merely as work, but as a small and meaningful moment in the ongoing story of making things that did not previously exist;

 

AND WHEREAS, the Client, in a similarly hopeful spirit, has chosen to proceed under the quiet but ever-present belief that something rather nice—possibly even better than imagined—may emerge from the process;

 

AND WHEREAS, both parties acknowledge that hope, while delightful, is not enforceable;

 

NOW, THEREFORE, with appreciation, curiosity, and a mutually understood tolerance for unpredictability, the following is agreed:

 

ON THE NATURE OF HOPEFUL EXPECTATION

Client acknowledges that while REDNUG® LLC may approach each project with enthusiasm, care, and a quiet confidence that something commendable—or at least interesting—will result, such sentiments exist in the realm of optimism rather than obligation. The phrase “this should turn out great” shall be interpreted as an expression of spirit, not a measurable guarantee.

 

ON THE ART OF THINGS NOT GOING ENTIRELY AS PLANNED

Client further acknowledges that laser engraving, much like life, cooking, and assembling furniture without reading instructions, is subject to variables that may subtly—or dramatically—alter the intended course. Materials behave as they wish, machines have personalities, and outcomes occasionally chart their own path.

 

ON THE CURIOUS ABSENCE OF GUARANTEES

Notwithstanding any excitement, encouragement, or well-placed confidence expressed before, during, or after the process, REDNUG® LLC makes no promises, warranties, guarantees, assurances, or prophetic declarations regarding the final result. Any belief to the contrary shall be considered charming, but ultimately self-generated.

 

ON THE POSSIBILITY OF DELIGHT (AMONG OTHER THINGS)

Client agrees that the final product may, in certain favorable alignments of circumstance, exceed expectations and inspire admiration, satisfaction, or even a brief moment of “well, that turned out better than I thought.”

Client further agrees that it may also… not.

 

ON THE ACCEPTANCE OF ALL OUTCOMES, INCLUDING THE SURPRISING ONES

Client acknowledges and accepts that outcomes may range from excellent to unconventional to “huh, that’s not quite what I pictured,” and agrees that all such results fall within the broad and artistically flexible definition of “what happened.”

 

ON THE WAIVER OF SECOND THOUGHTS

Client hereby waives any inclination—whether immediate or arising later at 2:17 a.m.—to reconsider, reinterpret, or retroactively question the outcome as grounds for complaint, claim, or existential frustration directed toward REDNUG® LLC.

 

ON THE COMPLETE AND UTTER LACK OF LIABILITY, DESPITE BEST INTENTIONS

REDNUG® LLC, while appreciative, diligent, and occasionally proud of its work, shall not be held responsible for any result, including those that may differ from expectations, sketches, conversations, or hopeful mental images formed during moments of optimism.

 

ON THE NON-EXISTENCE OF REMEDIES, FIXES, OR DO-OVERS

Client agrees that, once completed, the project enters a state of finality best described as “it is what it is,” and that REDNUG® LLC shall not be obligated to revisit, revise, redo, replace, refund, or otherwise engage in acts of corrective hindsight.

 

ON THE PRIVILEGE OF THE PROCESS ITSELF

Client acknowledges that participation in this process—entrusting an idea to transformation—is, in itself, part of the value received. The experience, much like the result, is accepted in its entirety, including any unexpected plot twists.

 

ON INTERPRETATION IN FAVOR OF REDNUG® LLC (WITH GRATITUDE)

This Agreement shall be interpreted as broadly and protectively as possible in favor of REDNUG® LLC, even—and especially—in the presence of language expressing excitement, encouragement, or the vague but pleasant suggestion that things will probably turn out quite nicely.

 

ON FINAL ACKNOWLEDGMENT (READ OR NOT, UNDERSTOOD OR NOT, STILL SOMEHOW AGREED TO)

By proceeding in any manner—whether through action, inaction, payment, message, nod of approval, or general forward momentum—Client affirms both: (a) an understanding that outcomes are not guaranteed, and

(b) an appreciation that REDNUG® LLC is genuinely honored to have had the opportunity to create whatever it is that has now been created.

 

IN WITNESS WHEREOF—though no pen need meet paper and no eyebrow need fully un-furrow—the Client, by continuing onward, accepts both the uncertainty of the result and the enthusiasm with which it was produced.
